1. Provider and scope
These terms of use and general terms and conditions (hereinafter "terms of use") apply to the use of the website, web application, mobile applications and other associated services offered by RideTree.
The provider of RideTree is:
Steffen Greven
Kupferdreher Straße 266
45257 Essen
Germany
Email: info@ridetree.de
Hereinafter referred to as "RideTree", "we" or "us".
These terms of use apply both to the free use of RideTree and to paid services, in particular the RIDE and RIDE+ memberships.
Where individual functions can be used without registration, the relevant provisions of these terms of use also apply to that use.
2. Scope of RideTree's services
RideTree is a platform for motorcycle riders. In particular, it serves to connect riders and to plan, organise, record and discover motorcycle-related activities.
The range of functions may include in particular:
- user profiles,
- management of your own motorcycles and motorcycle images,
- posts, comments, reactions and other community functions,
- groups and communities,
- dates and events,
- spontaneous rides,
- tours and tour planning,
- route calculation and navigation functions,
- import, export and processing of GPX data,
- recording of rides and GPS data,
- spots and motorcycle meeting points,
- passes and regions,
- collections,
- reviews and recommendations,
- statistics and analyses,
- badges, achievements, points, levels and rankings,
- location and nearby functions,
- RideRadar,
- safety and notification functions, and
- other functions relating to motorcycling and community.
The specific range of functions may depend on the device used, the platform, the location, the selected membership and other technical requirements.
3. Registration and user account
Creating a user account is required to use certain functions.
Users are obliged to provide the information required for registration truthfully and to update any material changes.
Unless RideTree expressly permits otherwise, each person may in principle have only one personal user account.
The automated creation of user accounts, in particular by bots, is not permitted.
User accounts may not be sold, transferred or permanently left for use by other people without RideTree's consent.
Access data must be treated confidentially and appropriately protected against access by third parties.
If there is any suspicion that third parties have gained unauthorised access to a user account, RideTree must be informed without undue delay.
4. Minimum age
Registering your own RideTree user account is in principle only permitted for persons of legal age.
Publicly accessible areas of RideTree may, where applicable, also be viewed without a user account.
5. Community and conduct
RideTree is intended to enable respectful and safe exchange within the motorcycle community.
In particular, it is not permitted to use RideTree to:
- insult, threaten or harass other people,
- spread discriminatory, inhuman or inciting content,
- publish or spread unlawful content,
- call for criminal offences or other unlawful behaviour,
- publish personal or confidential data of third parties without authorisation,
- impersonate another person or deceive other users,
- spread spam or unwanted advertising,
- publish fraudulent offers or content,
- spread malware or technically harmful content,
- circumvent RideTree's security mechanisms,
- impair RideTree's technical infrastructure,
- read out or exploit data by automated means contrary to these terms, or
- infringe the rights of third parties.
Additional community or group rules may apply to individual areas, groups or communities.
6. User content
Depending on the range of functions, users can publish, store or share their own content on RideTree.
This may include in particular:
- texts and posts,
- comments,
- images and photos,
- profile and motorcycle information,
- tours and tour planning,
- GPX and route data,
- spots and meeting points,
- reviews,
- dates and events, and
- other community content.
The respective user is responsible for the content they provide.
Users may only provide content for which they hold the necessary rights.
In particular, publication must not infringe any copyrights, trademark rights, personal rights, data protection rights or other rights of third parties.
7. Rights of use in user content
The rights to content created by users generally remain with the respective user or rights holder.
By uploading or publishing content, the user grants RideTree a simple, free-of-charge right of use, insofar as this is necessary for the operation and provision of the respective RideTree function.
This right includes in particular technical storage, reproduction, transmission and display within RideTree in accordance with the visibility selected by the user.
RideTree may carry out technically necessary editing, for example resizing or compressing images, creating preview images, converting file formats and technically processing route, map and GPX data.
The right of use generally exists only for as long and to the extent necessary to provide the respective content and the corresponding RideTree functions.
Statutory retention obligations and the legitimate interests of other users in existing communication histories remain unaffected.
8. Visibility of content
Within the functions offered by RideTree, users can determine with whom certain content is shared.
Publicly published content may also be visible to non-registered people and, where applicable, be captured by search engines or other services.
For content within groups, communities or other restricted areas, visibility depends on the respective settings and permissions.
9. Moderation and reporting of content
RideTree may review, restrict, block or remove content if there are specific indications that it violates applicable law, these terms of use, community rules or the rights of third parties.
Where required by law, the users concerned will be informed of such measures and the reasons for them.
Users can report unlawful content or content that violates these terms via the existing reporting functions or the contact options provided.
10. Groups and communities
RideTree may enable users to create, manage or join groups and communities.
Depending on the range of functions, users may be given different roles and permissions within such areas, for example as administrator, moderator or member.
These roles do not establish any power of representation vis-à-vis RideTree.
In the event of serious violations of applicable law, these terms of use or community rules, RideTree may take appropriate measures.
11. Tours, routes and navigation
Tours, routes, navigation instructions, GPX data, passes, spots and other geographic information provided or calculated via RideTree or created by users are intended to help plan and support rides.
RideTree cannot guarantee that a displayed or calculated route is actually passable at all times, publicly accessible, permitted for motorcycles, free of closures or up to date with regard to road layout and traffic situation.
Roads may be impassable or passable only to a limited extent due in particular to roadworks, events, weather conditions, seasonal closures, traffic measures, natural events or other circumstances.
The actual traffic situation, traffic signs, official orders and the applicable road traffic regulations always take precedence over information and route suggestions from RideTree.
Users are themselves responsible for checking whether a route is actually and legally passable.
12. Safety when riding a motorcycle
Using RideTree does not release users from their personal responsibility on the road.
Riding must be adapted in particular to road and traffic conditions, weather conditions, personal riding experience, physical condition, the condition of the vehicle and other actual conditions.
A smartphone, navigation device or other terminal device may only be operated while riding within the framework of the applicable statutory provisions.
RideTree does not encourage users to exceed speed limits, ride riskily or otherwise violate traffic rules.
13. Location, RideRadar and safety functions
Individual RideTree functions may use location data. These may include in particular RideRadar, ride recordings, spontaneous rides, nearby searches, tour functions, location sharing and safety functions.
For technical reasons, location information may be inaccurate, delayed or temporarily unavailable.
RideTree's location, safety and notification functions are not an emergency call service and not a professional emergency, rescue or monitoring system.
In emergencies, users must not rely on RideTree automatically detecting an accident, a dangerous situation or the failure of a user to appear, or reliably notifying help.
In emergencies, the competent official emergency and rescue services must be contacted.
14. Information from other users
RideTree does not guarantee that information from other users is correct, complete or up to date.
This applies in particular to tours, routes, spots, reviews, events, meeting points, road conditions and other information provided by users.
15. Map, routing and third-party services
RideTree may use data and technical services from external providers, for example for map material, geocoding, route calculation, notifications or other technical functions.
The availability and accuracy of such services may depend on the respective third-party providers.
Where necessary, the respective licence or usage terms of the providers concerned also apply.
16. GPS and technical accuracy
GPS, location, altitude, speed, distance and other measurement data may be subject to technical deviations.
Accuracy may be affected in particular by the device used, GPS reception, buildings, terrain, weather conditions, energy-saving functions or background restrictions of the operating system.
Statistics, kilometre figures, speeds, elevation gain and comparable information from RideTree are not to be understood as official or calibrated measured values.
17. Badges, points, levels and rankings
RideTree may offer virtual points, levels, badges, achievements, rankings and comparable gamification functions.
These generally have no monetary value and do not establish any claim to payment or other remuneration.
RideTree may correct or remove points, achievements, badges or other virtual awards that were acquired incorrectly or abusively.
Manipulation or any attempt to artificially influence in particular kilometres, GPS data, activities, points, achievements or rankings is not permitted.
18. Free and paid use
RideTree can be used free of charge and as part of paid memberships.
In particular, RideTree offers the following plans:
- FREE
- RIDE
- RIDE+
The current scope of services is set out in the plan and service overview published on RideTree.
For a paid contract, the scope of services displayed to the user immediately before the contract is concluded is decisive.
19. RIDE and RIDE+
RIDE and RIDE+ are paid memberships that may contain additional or extended functions as well as higher usage limits compared with free use.
These may include in particular:
- RIDE or RIDE+ badges,
- higher or extended limits for motorcycles and images,
- extended functions for spontaneous rides,
- extended tour planning,
- additional search and filter options,
- extended information on passes,
- higher or unlimited collection limits,
- additional profile design options,
- extended statistics and analyses, and
- other services marked as RIDE or RIDE+ functions.
The specific scope of services of RIDE and RIDE+ is displayed before the respective membership is taken out.
20. Terms of RIDE and RIDE+
RIDE and RIDE+ may be offered with different terms.
20.1 Monthly membership
The monthly membership is concluded for the monthly contract or billing period stated in the order process.
Whether and under what conditions an automatic renewal takes place is displayed to the user before they place their order.
20.2 Season membership
The season membership has a fixed term of three months.
Payment is made once for the entire three-month period.
The season membership ends automatically after the three months have expired. There is no automatic renewal.
20.3 Annual membership
The annual membership is concluded for a contract or billing period of one year.
Whether and under what conditions an automatic renewal takes place is displayed to the user before they place their order.
The contract conditions presented in the specific order process are decisive.
21. Prices and conclusion of contract
For RIDE and RIDE+, the prices displayed to the user immediately before completing the respective order apply.
Prices may differ depending on the plan, term, promotion, discount or other conditions offered.
For consumers, the legally required price information including any applicable taxes is shown.
Before placing the paid order, the user is shown in particular the selected plan, its essential services, the term, the total price and any applicable renewal and termination conditions.
The contract is concluded upon completion of the intended order process and the corresponding contract confirmation.
The user receives a contract confirmation on a durable medium, for example by email.
22. Payment
The available payment methods are displayed during the order process.
Payment may be processed by external payment service providers.
The contract and data protection terms of the respective payment service provider may additionally apply to payment processing.
The user is obliged to provide the information required for payment processing completely and correctly.
23. Immediate start of RIDE and RIDE+ services
At the consumer's express request, RIDE and RIDE+ functions may be activated and provided before the statutory withdrawal period has expired.
If the consumer expressly requests that RideTree begin performance before the withdrawal period has expired, RideTree may activate the booked premium functions immediately after the contract has been successfully concluded or payment has been successfully processed.
Before making the corresponding declaration, the consumer is informed of their right of withdrawal and the possible consequences of a withdrawal after the service period has already begun.
24. Recurring memberships and renewal
Where an automatic renewal is expressly agreed when the contract is concluded, the renewal conditions presented in the order process apply.
Recurring payments are made in accordance with the billing period agreed when the contract was concluded.
The season membership is excluded from this and ends automatically after the agreed three months have expired.
Mandatory statutory provisions on contract renewals and termination options remain unaffected.
25. Termination of paid memberships
Paid memberships may be terminated in accordance with the conditions agreed when the contract was concluded and the statutory provisions.
Where required by law, RideTree provides a directly and easily accessible electronic termination option.
In the case of ordinary termination, the paid scope of services generally remains available until the end of the contract period already paid for.
After the paid membership has ended, the user account generally continues as a free RideTree account, unless the user account is also deleted.
The right to extraordinary termination for good cause remains unaffected.
26. Switching between RIDE and RIDE+
RideTree may enable users to switch between RIDE and RIDE+.
Before a plan change is carried out, the conditions applicable to it are displayed to the user.
This concerns in particular the time of the plan change, the new scope of services, the remaining term and any crediting of payments already made.
27. Vouchers, discounts and promotions
RideTree may offer vouchers, discount codes, referral programmes, promotional offers or special conditions.
Additional conditions may apply to individual promotions.
Unless stated otherwise, vouchers and discounts cannot be paid out in cash and cannot be combined at will.
In the event of abusive or manipulative use, RideTree may refuse the redemption of a voucher or reverse granted benefits within the scope of the legal possibilities.
28. Availability of RideTree
RideTree strives to provide its services as reliably and uninterruptedly as possible.
However, availability at all times and completely free of errors cannot be guaranteed.
Maintenance work, security measures, technical faults, failures of external service providers or events beyond RideTree's control in particular may lead to temporary restrictions.
29. Changes to and further development of RideTree
RideTree is continuously being developed.
Functions may be adapted or further developed in particular for technical, legal, safety-related or functional reasons.
For paid digital services, changes to the scope of services owed are made only within the framework of the statutory requirements.
Mandatory statutory rights of users remain unaffected.
30. Default in payment
If a due payment cannot be made or the user is in default with a payment, RideTree may restrict access to the paid functions in accordance with the statutory provisions.
Further statutory rights remain unaffected.
31. Suspension and sanctions
In the event of violations of these terms of use, community rules or applicable legal provisions, RideTree may take appropriate measures.
Depending on the nature and severity of the violation, these may include:
- notices or warnings,
- removal of individual content,
- restriction of certain functions,
- temporary suspension of the user account, or
- permanent suspension or termination of the user account.
When selecting a measure, particular consideration is given to the nature, severity, duration and frequency of the violation and to the legitimate interests of the user concerned.
The right to extraordinary termination for good cause remains unaffected.
32. Termination and deletion of the user account
Users can in principle end their free usage contract at any time and delete their user account using the function provided for this purpose.
Terminating a paid membership and deleting the RideTree user account are separate processes.
Deleting an account therefore does not automatically replace a required termination of a paid membership that still exists.
Before deleting an account, users should back up any data they wish to keep using any available export or download options.
After termination, personal data will be deleted or anonymised in accordance with the statutory provisions and the privacy policy, unless statutory retention obligations or other legal bases preclude deletion.
Content that forms part of shared communication histories may be retained in anonymised form to the extent permitted by law if its complete removal would impair the context of discussions or other content.
33. Rights to RideTree
Software, design, logos, trademarks, databases, texts, graphics and other content created or licensed by RideTree itself are protected by the respectively applicable property rights.
Users merely receive the right to use RideTree within the intended range of functions and these terms of use.
Any further reproduction, distribution, editing or commercial use is not permitted without the corresponding authorisation.
Uses permitted by law remain unaffected.
34. Liability
RideTree is liable without limitation for damage caused intentionally or through gross negligence and for damage resulting from injury to life, body or health in accordance with the statutory provisions.
In the event of a slightly negligent breach of essential contractual obligations, liability is limited, within the framework of the statutory requirements, to the foreseeable damage typical for the contract.
Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely.
Mandatory statutory liability provisions remain unaffected.
The above liability provisions apply accordingly to legal representatives and vicarious agents of RideTree.
35. Statutory warranty rights
The statutory warranty and defect rights apply to paid digital products and services.
These are not restricted by these terms of use insofar as a restriction is not permitted by law.
36. Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal in the case of a distance contract for a paid RideTree membership.
The withdrawal period is generally fourteen days from the day the contract was concluded.
Consumers are separately informed of the existing right of withdrawal before or when the contract is concluded.
36.1 Information on the right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.

by means of a clear statement (for example a letter sent by post or an email) of your decision to withdraw from this contract.
You may use the model withdrawal form below for this purpose, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
36.2 Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we are informed of your withdrawal from this contract.
We will make this reimbursement using the same means of payment you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
36.3 Compensation in the event of a requested early start of performance
If you have expressly requested that RideTree begin providing the booked RIDE or RIDE+ services before the withdrawal period has expired and you subsequently withdraw from the contract within the withdrawal period, compensation in accordance with the statutory provisions may be owed for the services already provided up to the time of withdrawal.
The compensation is generally calculated according to the proportion of the services provided up to the time of withdrawal in relation to the total scope of the contractually agreed services. It is generally based on the agreed total price.
A prerequisite for such compensation is in particular that you have expressly requested that RideTree begin performance before the withdrawal period has expired and that you have been properly informed of your right of withdrawal and the conditions for compensation.

38. Electronic withdrawal option
Where required by law, RideTree provides a prominent and easily accessible electronic option for declaring withdrawal during the statutory withdrawal period.
Using this electronic withdrawal option is not a prerequisite for validly exercising the right of withdrawal in any other way permitted by law.
39. Data protection
Information on the processing of personal data is contained in RideTree's separate privacy policy.
40. Changes to these terms of use
RideTree may change these terms of use if there is an objective reason for doing so and the change is reasonable and legally permissible, taking into account the interests of users.
An objective reason may exist in particular due to:
- changed legal or regulatory requirements,
- court or official decisions,
- new or substantially changed functions,
- technical developments, or
- necessary security measures.
Where a change requires the user's consent, RideTree will obtain this consent.
Registered users will be informed appropriately of material changes.
41. Consumer dispute resolution
RideTree is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
42. Applicable law
The law of the Federal Republic of Germany applies.
For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence.
43. Final provisions
Should individual provisions of these terms of use be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.
Invalid provisions are replaced by the respectively applicable statutory provisions.
Mandatory statutory provisions and consumer rights remain unaffected.
